Who are the Electors of the Electoral College?

trumpcorruptOn December 19, the electoral college will vote on who the next president of the U.S. will be, and they are not all bound by law to vote for Mr. Trump. Now that it’s been concluded that Clinton won the popular vote by more than 2 million, it would be within the Eletoral College’s purview to change who they vote for.

At the same time, Constitutional experts are arguing that unless Donald Trump divests himself of all of his foreign business holdings, he will be in violation of Article 9, Section 1 of the U.S. Constitution as soon as he takes his oath to uphold it.

Institutionalizing Corruption in the U.S. Presidency?

The U.S. Constitution’s “Emoluments clause,” prohibits any person holding federal office from accepting “any present, emolument, office, or title, of any kind whatever, from any king, prince, or foreign state.” An emolument is any type profit, payment or reward derived from holding office. The clause was meant to prevent people holding federal office from being influenced by foreign governments, or using elected office for personal financial gain. In short, the clause was put in place to prevent corruption at the highest levels of U.S. government.

The only exception to the Emoluments Clause could come if Congress approved the emoluments or suspended the clause for a specific federal employee, which they could do for Mr. Trump, if they dared. With Republican majorities in the House and Senate, though, there is a distinct possibility that the Republicans will officially allow the next U.S. President to violate the U.S. Constitution and benefit financially from holding the office.

We could be on the brink of making this kind of corruption official U.S. doctrine during the Trump presidency, unless Trump distances himself adequately from the operation of his own businesses around the globe. He never promised during his campaign that he would do so, though, and doesn’t seem on track to do it now. In fact, he’s been heading in the wrong direction, hosting foreign executives who are currently building Trump edifices in India, and promoting his Washington, D.C. hotel to foreign dignitaries.
