Citizens Flood City Hall with Calls of Outrage Over Brainard Issue

The Grand Junction Daily Sentinel has published audio of telephone calls made by outraged citizens to City Hall about councilman-elect Rick Brainard’s intent to assume office on May 6. Mr. Brainard was arrested April 6 for assaulting his girlfriend — just four days after he was elected to the Grand Junction City Council. In his police affidavit, Mr. Brainard admitting grabbing and pushing his girlfriend, pulling her hair and hitting her “on the left side of her neck/cheek area,” hard enough to cause a black eye. Mr. Brainard’s arrest affidavit (pdf) states, “Rick stated that he slapped Cindy because she ‘needed to shut her mouth.’ ” Citizens have been calling City Hall to express outrage at Mr. Brainard’s intent to take his seat, and asking the City to do something stop him. One caller was angry at Mr. Brainard’s request to Mesa County Court Judge Craig Henderson avoid all of his court appearances. Another caller complained he cannot get a job because he has the same charge on his record, and yet Mr. Brainard will be allowed to serve on City Council. Following are some excerpts from the calls:

“My husband and I voted for this lowlife that is in jail right now. I wish you would ask for his resignation…”

“…Just letting you know that if you keep Mr. Brainard on board, all you are doing is letting the people of Grand Junction know that it’s ok to be a wife beater…”

“The fact that I can’t get a job with the same record, …I’m just curious how it is a man can stay on…I can’t get a job as a CNA or get a CNA license or anything with the same record…”

“If you people keep Rick Brainard on City Council you have everything coming to you that happens. This is only the beginning. I know this guy.”

“I’m calling to express my outrage at Rick Brainard being able to keep his seat after being arrested for domestic violence…”

“I’d just like to register my utter outrage that RB is going to be allowed to still sit on City Council after admitting to the police that he struck a woman for something she said, and I cannot believe the message this sends to the female members of our community…”

“This is not the type of individual I want as part of my City Council. I find it embarrassing…”

Citizens are planning to protest Mr. Brainard at his swearing in on Monday, May 6. Mr. Brainard’s first court date coincidentally is that same morning, just two hours before he is scheduled to be sworn onto City Council.

G.J. Chamber of Commerce Finds Its Fortunes Sinking with Brainard’s

The fortunes of the Grand Junction Colorado Area Chamber of Commerce are sinking this week alongside those of embattled councilman-elect Rick Brainard, an executive at West Star Aviation in Grand Junction, who faces criminal charges for allegedly assaulting his girlfriend during a domestic altercation April 6. Grand Junction Police arrested and charged Mr. Brainard just four days after he won election to the Grand Junction City Council. Appalled citizens have been marching, chanting, holding rallies and organizing phone banks to protest Mr. Brainard assuming his seat on Council. This week outraged citizens picketed the G.J. Chamber, which continues to stand steadfastly behind Mr. Brainard. Just days ago, Mr. Brainard resigned from the Chamber’s board, but the Chamber still backs him. Adding to the Chamber’s woes, this week, the City of Grand Junction voted to yank its $6,000 membership in the Chamber, saying the Chamber has changed from an economic development organization into an overtly political group. As if losing the City’s lucrative membership and being targeted with loud protests by Grand Junction citizens wasn’t enough, this week thieves targeted the Chamber stealing a number of copper backflow devices said to be valued at thousands of dollars. To top it all off, an alternative Chamber of Commerce announced its debut this week in town: the Western Colorado Latino Chamber of Commerce, with dues that are a fraction of the GJ Chamber’s dues, making the Latino Chamber far more accessible to smaller businesses.

Brainard Issue Sparks Fireworks at Council Meeting

Grand Junction City Councilman Sam Susuras, whom citizens reprimanded for backing Rick Brainard. Rumors have emerged that the Chamber's four newly-elected candidates have met in secret and plan on making Susuras mayor as soon as they are sworn in.

As the first civil union in Mesa County was taking place across town in Grand Junction, Colorado, verbal fireworks flew at the last meeting of the sitting Grand Junction City Council. In a surprise move, Council voted 4-2 to drop the City’s membership in the Grand Junction Area Chamber of Commerce, which has continued to support embattled councilman-elect Rick Brainard. Brainard was arrested on charges of third degree assault and harassment after allegedly pushing and hitting his live-in girlfriend in the face just four days after he was elected to office April 2. The arrest has outraged the community and galvanized a grassroots effort to keep Brainard from taking his seat on Council. In a recent TV interview in his own defense, Mr. Brainard called citizens who oppose him “an uninformed lynch mob,” and insisted he will take his seat despite the charges. His statements further inflamed citizens, who have vowed to recall him as soon as the law permits it. The City has said a recall effort will cost taxpayers $45,000. Citizens against Brainard have conducted rallies and marched outside the Chamber of Commerce building and City Hall wearing black and white “No Brainard” T-shirts and “wife beater” undershirts that say “Domestic Violence is a No-Brainard.” Several businesses vowed to quit the Chamber if Mr. Brainard is sworn in and the Chamber continues to back him. The City of Grand Junction for many years was a “Chairman’s Circle” level member of the Chamber — the most expensive membership the Chamber offers, at a cost to taxpayers of $6,000 per year. Councilman Jim Doody noted that the Chamber has also created a 501-c-4 (lobbying) group specifically for the purpose of influencing local elections, but did not disclose how much it spent influencing the last election.

The saga of embattled city councilman-elect Rick Brainard continues to unfold in Grand Junction, Colorado as citizens continue to pressure Brainard to resign his seat on City Council. Brainard, 51, won election to the Grand Junction City Council on April 2, but on April 6 was arrested on charges of third degree assault and harassment after admitting to hitting his live-in girlfriend in the face in a domestic dispute. Brainard said in a police affidavit that he struck his girlfriend because she “needed to shut her mouth.” His remarks have drawn the ire of the community. Most of the sitting city council members signed a resolution calling on Mr. Brainard to resign his seat. The local paper, the Grand Junction Daily Sentinel, endorsed Brainard prior to his election, but rescinded its endorsement and published an editorial calling on him to reject his seat on Council. The Grand Junction Area Chamber of Commerce also endorsed Brainard for office, but has so far refused to pull their support for him, saying he is “entitled to due process.” Brainard served on the Chamber’s board. Mr. Brainard so far has vowed to take his seat on Council despite the furor. He is scheduled to be sworn into office on May 6, coincidentally the same day that he is supposed to make his first court appearance in his assault case.

On Tuesday, April 3, Rick Brainard, Vice President of Business Development at West Star Aviation in Grand Junction, Colorado was celebrating his election to City Council. On Saturday, April 6, he was arrested, put in a yellow jumpsuit and thrown in jail on charges of third degree assault after he admitted to police that he pushed, shoved, and struck his live-in girlfriend in the face. In his police affidavit, Brainard first denied the altercation, then said he had to strike his girlfriend because she “needed to shut her mouth.” That admission has inflamed citizens and last week a hundred people rallied at City Hall demanding Mr. Brainard not take office. Sitting Grand Junction City Council members have sent Mr. Brainard a letter to asking him not to assume office amid his legal flap, saying the case is embarrassing the City. The City is legally powerless to keep Brainard from taking his seat on Council, and despite the public pressure, Brainard has vowed to assume his seat on Council. If he does, citizens have vowed to start a recall effort. The City Clerk estimates a recall would cost the City about $45,000. In the meantime, the matter has gotten coverage across the U.S., including in Denver, San Francisco and Seattle, and an online petition demanding Mr. Brainard’s resignation, titled “Woman-Beating Councilmember Must Go,” has gone viral. As of 3:00 p.m. Sunday, April 21 the petition had 13,731 signatures and the number is growing at the rate of several thousand more a day. Even worse for Mr. Brainard, his mugshot now appears on MugShots.com.

To the GOP: If Gun Control Doesn’t Work, Try This Instead

Laws to regulate guns just don’t work. At least that’s what many prominent Republicans say. In the mean time, the U.S. is awash in guns, judging from the piles of them turned in at buyback programs across the country. While it is unclear whether these programs actually reduce gun deaths, they do prove one thing: Americans have more guns than they know what to do with. Add to this emerging technology that, when gun nuts perfect it, will allow people to manufacture guns using 3-D printers, and we may be so deep in trouble we’ll never dig out. This distribution method will make it completely impossible for government to regulate who gets a gun and who doesn’t. Gun owners and pro-gun legislators repeatedly tout the portion of the Second Amendment that talks about their right to bear arms, but universally ignore the part indicating gun owners are expected to be part of a “well-regulated militia.” All these factors point to one conclusion: the time may have already passed when we could realistically regulate guns to any desired effect.

So now what?

G.J. Citizens Rally to Protest Brainard Taking Office

About 100 citizens of Grand Junction, Colorado rallied outside City Hall today to protest city councilman-elect Richard Brainard’s stated intent to assume office in early May. Linda Moran of the Latimer House organized the rally. Latimer House provides shelter for battered women. Brainard was arrested last weekend after admitting to police that he struck his live-in girlfriend. City Councilman Jim Doody spoke at the rally, saying Mr. Brainard had already highly embarrassed the city and that citizens are rightly concerned about Brainard’s behavior. Doody announced that he and fellow councilmember Bennett Boeschenstein plan to write a letter, which they will submit to the rest of Council, asking Brainard not to assume office. The crowd cheered and applauded. Doody warned, however, that Brainard, who has been duly elected, could assume office if he wanted to. Several citizens who spoke said they had voted for Brainard and were now sorry they had. One woman, with three children in tow, said the first thing she teaches her children is not to hit other people, ever. Brainard initially lied to the police after they arrived at his residence early Saturday morning, and denied a physical altercation with his girlfriend. He later admitted to grabbing, pushing and slapping her. A non-redacted version of the police report says “Rick stated that he slapped (girlfriend) because she needed to ‘shut her mouth,” saying she said something so offensive to him “that he had to slap her.” It was also announced at today’s rally that a group of state-approved domestic violence treatment providers from across the western slope have issued a statement asking Brainard not to take office. Brainard’s next court appearance is May 6, the same day he is scheduled to be sworn into office. Brainard’s lawyer has asked the court to waive the requirement that Brainard attend his court status conference May 6, as well as all future hearings, due to conflicts with his “employment.”

Petition: Require Lawmakers to Wear Logos of Financial Backers on their Clothing

Petition’s suggested attire for members of the House and Senate

A new petition appeared on the Obama administration’s “We the People” web site March 18 asking that members of the Congress and Senate be required to wear the logos of their financial backers on their clothing, NASCAR style. The petition says, “Since most politicians’ campaigns are largely funded by wealthy companies and individuals, it would give voters a better sense of who the candidate they are voting for is actually representing if the company’s logo, or individual’s name, was prominently displayed upon the candidate’s clothing at all public appearances and campaign events. Once elected, the candidate would be required to continue to wear those ‘sponsor’s’ names during all official duties and visits to constituents. The size of a logo or name would vary with the size of a donation. For example, a $1 million dollar contribution would warrant a patch of about 4″ by 8″ on the chest, while a free meal from a lobbyist would be represented by a quarter-sized button. Individual donations under $1000 are exempt.” Some people have commented that the NASCAR-style clothing requirement would break Congress’s dress code, but the code only requires a coat and tie for men and “appropriate” dress for women. Others say members of Congress and the Senate would have to wear floor-length robes, perhaps with trains, to accommodate all of their corporate backers. So far, the Congressmen-in-NASCAR-clothing petition has gathered 9,378 signatures in just four days. The Obama Administration has raised the number of signatures needed to get a response on a petition to100,000 within 30 days, up from 25,000. The petition can be seen (and signed) here.

Grassroots Group Succeeds in Peeling Away Heartland Institute’s Funding

Screen shot 2013-01-20 at 11.48.55 AM A group called Forecast the Facts is leading a campaign to peel away corporate funders who give money the Heartland Institute, a prominent think tank that has been a leader in the effort to deny climate science. Heartland is known for its harsh and divisive anti-climate change PR tactics, like running cringe-inducing billboards along major highways that liken people who believe in climate change to mass murderers like Charles Manson and the Unabomber, Ted Kaczyinski. The Heartland Institute has flourished through funding from large corporations and industries that have a stake in climate change denial, including ExxonMobil, The U.S. Chamber of Commerce, Murray Energy Corporation, Altria/Philip Morris, Microsoft, General Motors and biotech companies like Amgen and Bayer. Forecast the Facts’ grassroots effort to peel away funders looks like it’s paying off, too. The group calculated Heartland’s corporate and trade association funding for 2012 based on the amounts Heartland projected they would take in in their 2012 fundraising plan. Of $2.3 million in projected funding, Forecast the Facts has succeeded in getting corporations to withdraw $1.3 million, leaving about $990,000 remaining. More than 150,000 people have weighed in with various corporations through the project and urged them to pull their funding from Heartland. On its website, Forecast the Facts lists Heartland’s remaining corporate funders, the approximate amount the companies donate to the think tank, and phone numbers at each corporation that people can call to ask the company to stop funding Heartland.

They Said It Couldn’t Be Done: NY State Passes Comprehensive Gun Safety Bill

With lightening speed for a state legislature, New York became the first state to pass a comprehensive gun safety bill since the massacre December 14, 2012 at Newtown, Connecticut. New York’s gun control bill, passed and signed today, is the toughest in the nation. It expands the definition of “assault weapon” to include semiautomatic weapons to include those with just one feature commonly associated with military weapons, like a bayonet mount, flash suppressor or pistol grip. Previously the definition required two features. New York’s bill also revokes or suspends gun licenses held by people whom mental health experts determine to be a danger to society. The new law limits magazines to just seven rounds of ammunition instead of ten, and provides for enhanced monitoring of ammunition purchases to flag high-volume buyers. Gun licenses must be re-certified every five years. (They used to never expire.) The law increases penalties for illegal gun possession and for using a gun against emergency responders. “Common sense can win,” said New York Governor Andrew Cuomo as he signed the bill, less than an hour the New York State Assembly passed it by a vote of 104 to 43 . “You can overpower extremists with intelligence and with reason and common sense,” Cuomo said. The National Rifle Association called the law “draconian,” and said it was passed “under a veil of secrecy in the dark of night.” The bill passed on the second day of New York state’s 2013 legislative session.

Agribusiness Pushes “Ag-Gag” Laws Aimed at Keeping Animal Abuse Secret

Whistleblowing employees in the food industry have been credited with exposing horrible instances of animal abuse, unsafe working conditions, and environmental and public health violations on industrial factory farms by filming these conditions and exposing them to the public. But instead of fixing the problems these workers expose, the agribusiness industry is responding by pushing through laws that effectively block the pubic from finding out about these abuses in the first place. These whistleblower suppression, or “ag-gag” bills, criminalize taking photographs or video recordings at factory farms without permission, ban the distribution of such photos or videos and make it a crime to take a job at a commercial farm operation for the purpose of exposing what goes on there. These industry-backed bills would stop undercover activity like that used by the Humane Society of the United States (HSUS) in 2008 to expose animal cruelty at a Vermont slaughter plant that led to a felony conviction and the plant’s closure, and a landmark investigation at a cow slaughter plant the same year that prompted the largest meat recall in U.S. history and spurred a new federal law banning the slaughter of “downer” cattle.

Expedia Uses its Clout to Crush Small, Independent Hotels

The owners of the Luna Blue Hotel on Mexico’s Caribbean coast reveal their experience with Expedia’s strong-arm tactics to try and ruin their business and push travelers to book at more bigger, more lucrative properties that have a more favorable relationship with the site.

Years ago, Tony and Cheri quit their jobs, left their lives in the U.S. and risked their entire life savings to pursue their dream of operating a small hotel on Mexico’s Caribbean coast. Their quaint, 18-room place, the Luna Blue Hotel, took some hits from the swine flu scare and state-side reports of central Mexico’s drug wars, but the couple vowed to hold on and get through it somehow. During that lean time, a representative of the powerhouse travel website Expedia approached the couple and offered to help them recover some of their lost business by listing their place on Expedia. The couple agreed it might be a good idea to list with the site, and signed on as an Expedia “partner.”

But almost immediately the relationship turned sour.

Gun Backlash Gathers Steam

The National Rifle Association has gone dark, shutting down its Facebook page, going silent on Twitter and staying silent on it’s blog as it hunkers down in face of anti-gun protesters marching on its Washington, D.C. headquarters in the wake of the Sandy Hook Elementary School massacre. WalMart, one of the world’s largest sellers of both guns and kids’ toys, announced it is pulling Bushmaster rifles off its shelves nationwide. And another large gun seller, Dick’s Sporting Goods, tastefully removed all guns from view at its store closest to Newtown, Connecticut, where the mass killing took place last Friday, and announced it will stop selling “modern sporting rifles” at stores nationwide. The California state treasurer is considering purging the state’s pension investment funds of stock in companies that manufacture guns, and Cerberus Capital Management, a big investment firm, divested itself of holdings in Freedom Group, which makes Bushmaster rifles like the one the shooter used at Sandy Hook. The California State Teachers’ Retirement Fund is also looking to divest itself of funds invested in Freedom Group. Meanwhile, online petitions demanding legislators move quickly to better regulate guns and gun purchases are gathering signatures at phenomenal rates. One petition we’ve been following on SignOn.org — the biggest one so far — continues to gather hundreds of signatures every hour and is currently up to almost 380,000 signors. Another petition on the White House’s “We the People” petition website that sprang up demanding the Obama administration take immediate action to limit access to guns has gathered 184,202 signatures. It needed just 25,000 signatures to get serious consideration by the Obama administration.

Petition Demanding Common Sense Federal Gun Safety Laws Gathers Quick Support

In almost the blink of an eye, an online petition demanding sensible federal-level gun safety laws has gathered more than 230,000 signatures, and is continuing to gather signatures at a rate of almost 2,000 per hour. The response to the petition was so overwhelming that shortly after starting it, the woman who began the petition changed the goal for the number of signers to 250,000. The petition’s impetus was the December 14 bloodbath at Sandy Hook Elementary School in Newtown, Connecticut in which a 20 year-old gunman entered the school and slaughtered 20 six and seven year old pupils and six adult employees who tried to save the children. The petition seeks closure of gun show loopholes that allow people to buy guns without background checks, an end to the online sale of ammunition, mandatory waiting periods for gun purchases during which thorough background checks are conducted, and mandatory psychological and medical evaluations prior to making gun purchases. The petition also requests that character references be provided and evaluated out prior to gun purchases. More accountability should be placed in the hands of retailers, the petition says. When patrons refuse wait periods, authorities should be notified. Gun handling training and testing should be mandatory, as should a renewal process that includes many of the above-mentioned evaluation terms. “Our second amendment rights are long overdue a reevaluation. How many more senseless and entirely PREVENTABLE shootings have to occur before we do something about Gun Control,” asks Staci Sarkin, the petition’s creator. The petition will be send to the House of Representatives. “As a citizen and constituent of this great country, I am asking that you take a firm stand and make a positive change by restricting access to guns and saving lives,” Sarkin’s petition states. First-Ever Global Census of Atheists Now Ongoing

The first-ever Atheist Census, an online project to count and collect demographic information on the world’s self-identified atheists, is back online following a denial of service attack that forced the website offline just 17 hours after its debut on December 7, 2012. By the time the attack occurred the Census had already had 8,800 confirmed entries and another 2,300 waiting to be confirmed. The data was retained and the site re-launched on December 16, 2012. It is unknown who carried out the attack, but the assumption is that it was a group or individual who didn’t like the idea of atheists being counted. The Atheist Alliance International (AAI), a global alliance of secular groups and individuals that promotes a more secular world and works to stem the influence of religion on public policy, is conducting the Census. AAI requires Census participants provide a legitimate email address that can be verified so they can assure a real person is behind each submission. Participants are allowed one entry in the Census. Information the Census collects is freely available through the Atheist Census website so atheists can view and demonstrate their own presence in each country. Time for GOP to Dump Norquist, Handmaiden of Cigarette Companies

Grover Norquist, who for decades has been the patron saint of anti-tax sentiment for Republicans, is fast losing relevance as Republicans finally start to grasp that the only way America can get out of its fiscal mess is to raise taxes. Legislators are starting to see that their allegiance must be to the United States of America and its people, and not to Grover Norquist. But for GOP legislators, leaving Norquist behind will be one of the best things they can do to help get some credibility back with the American public. By pledging their allegiance to Norquist for so many years, Republicans have put stock in one of the most reliable allies of one of the world’s most reviled industries: the tobacco industry. Previously-secret tobacco industry documents show Norquist and his group Americans for Tax Reform (ATR) have for decades been highly dependable allies to Big Tobacco. Norquist was always at the cigarette makers’ beck and call whenever they needed him. As ATR president, Norquist annually sought and received hundreds of thousands of dollars from Philip Morris and R.J. Reynolds to support the companies’ agenda of low cigarette and corporate taxes. In return for the big bucks, Norquist offered his organization up as a conduit for tobacco industry lobbying. Norquist figured prominently in Philip Morris’ quiet, internal 1995 “Get Government Off Our Back” project, in which the cigarette maker secretly created a phony “grassroots” group, to push to “shift government’s priorities” off regulating business. In 1999, Norquist helped cigarette makers fight President Clinton’s proposal to add a one dollar tax on cigarettes to fund health care. Norquist was cast as a “core ally” in Philip Morris’ efforts to enact “tort reform” to block people’s access to the courts. Norquist helped defend cigarette makers against the Department of Justice’s 1999 Lawsuit in which the industry was found guilty of perpetrating five decades of fraud against the American people. Philip Morris’ law firm of Covington and Burling even secretly took the privilege of drafting letters to government agencies, like FDA, that Norquist could sign so they would appear to be from ATR and not a tobacco company.

Have People Had Enough of Food Chemicals and Additives?

Food additives that sound more like chemicals from a lab are turning people off.

People who cringe at the weird-sounding chemical additives in food, like sodium stearoyl-2-lactylate, guar gum or disodium EDTA, are starting to create and share home-made versions of their favorite processed foods that are free of artificial chemicals and additives. On Pinterest, a social media website that facilitates sharing of recipes, a growing number of people are concocting and sharing chemical-free versions of their favorite highly-processed foods. One member shared a recipe for home-made “Condensed Cream of Something Soup,” offered as a chemical-free thickener to use in casseroles instead of expensive and additive-filled canned Campbell’s “Cream of” soups. Another person posted a recipe for home-made Oreos that has gotten raves. Still another person shared a way to make her favorite childhood processed food, Pop Tarts, at home using recognizable ingredients. Someone who claimed to be “disgusted” by processed, bottled Bleu cheese dressing posted a simple recipe for home-made Bleu Cheese dressing. Still someone else shared an easy recipe for do-it-yourself red enchilada sauce, saying “you’ll never go back to the canned, store-bought stuff again.” A substantial portion of our modern food supply is manufactured in factories using chemicals and additives, some of which, according for the Center for Science in the Public Interest, are poorly tested and may not be worth the risk of ingesting them.

Michigan Town Asked to Remove Christian Cross from Public Park

Frankenmuth, Michigan’s giant, 55-foot tall cross in “Cross Park”

Americans United for Separation of Church and State (AU) has formally asked (pdf) to the city of Frankenmuth, Michigan to remove a 55-foot tall Christian cross from a public park. The cross was erected in a 1976 ceremony attended by then-Mayor of Frankenmuth Elmer Simon, who, at the dedication ceremony, said that “The simple cross of Christ assures us that life does not end with death. From our local heritage, this Christian symbol suggests that we are also a community under Christ.” More recently, the City has referred to the cross as “a tribute to the religious commitment of the Frankenmuth community.” AU points out that the display of a Christian cross in a taxpayer-supported public park is an unlawful endorsement of Christianity. The First Amendment to the U.S. Constitution prohibits government from promoting one religion above all others, and from promoting religion over non-religion, the group says, citing legal precedent for the symbol’s removal. AU suggested the City remove the cross to private land, and wrote, “Failure to remove the cross will expose the City to a significant risk of litigation.” AU requested a response from the City within 30 days. Frankenmuth is a city of about 5,000 nicknamed “Little Bavaria” that trades on its Bavarian-themed, timber-framed architecture, shops, breweries and German culture.
