
On February 18, 2026, the Colorado Court of Appeals denied a request by disgraced former Mesa County Clerk Tina Peters to be released from prison on bond while she waits for a court to rule on an appeal of her overall case.
The Appeals Court said it lacked jurisdiction in the matter because Peters had filed the request far too late. The Court said that “more than 480 days have passed since the district court made the bond decision for which Peters now seeks review,” and the deadline to ask for a review of a district court’s decision to grant or deny a defendant bond pending appeal is 49 days from the date the district court first rendered its decision. The court can grant a 35-day exception to that deadline for “excusable neglect,” but that deadline had also passed long ago, the Court said, adding that in her application, Peters failed to acknowledge the untimeliness of her filing or try to provide a good reason for it being so late.
