Chamber Supports Amendment 68, Takes Mesa County Down Another Primrose Path

Dunce capThe Grand Junction Area Chamber of Commerce apparently loves some vices, but not others, and the “sins” the chamber backs don’t seem to match the desires of Mesa County citizens. Once again the chamber adds to its long list of disastrous political moves and fails to consider the big picture in their election-year endorsements.

The chamber recently announced it supports Amendment 68, which will pave the way for horse racing and large-scale video lottery terminals in Mesa County. Amendment 68 requires 34 percent of the gambling proceeds go to support schools.

Diane Schwenke, president of the Grand Junction Area Chamber of Commerce, said whether or not the local community wants gambling was the most important criteria for their support.

“As long as it’s up to the local residents, the local leadership,” she said. “That’s of paramount importance to us.”

But the chamber doesn’t really care about what the local residents think.

Name a simple, cost-free way to boost our area’s sagging local economy and put Grand Junction on a lot more tourist maps.

That’s right, it’s upgrading the Colorado National Monument to national park status.

The push to turn the Monument into a national park has won widespread support from a broad spectrum of the community, and for good reasons.

The Monument has all the natural features it needs to qualify as a national park, and making the change would clarify what tourists are looking for. Right now, tourists think the Colorado National Monument is a statue or a commemorative plaque. If the Monument were called a “park” instead, it would clarify what they are heading to see. Also, as a national park the Monument would draw more travelers from the airport and more tourists off I-70, boosting business at local hotels, restaurants, coffee bars, rental car companies, gas stations, art galleries and other businesses.

Sounds like a good idea, right? That’s because it is. And for that reason, the Grand Junction Economic Partnership endorses it. The Chamber of Commerce has supported it. The Grand Junction Visitors and Convention Bureau says it is a “clear opportunity to attract more visitors.” Even the Western Slope Colorado Oil and Gas Association supports it. The Daily Sentinel supports it, saying “Studies show that monuments which become national parks don’t necessarily see a big increase in the number of visitors. But they do see a change in the types of visitors, with more people coming from outside the immediate area, staying longer in the area and spending more money.”

So if upgrading the Colorado National Monument to a national park is such a no-brainer and it would do our area so much good, why isn’t the effort going forward full throttle?

A midwife in Vernal, Utah, has raised a red flag about a spike in the number of stillbirths and neonatal deaths in the small town in 2013. The statistic has emerged alongside explosive growth in drilling and fracking in the area. Energy companies have flocked to Vernal in the last few years to develop the massive oil and gas fields that underlie Uintah County.

The midwife, Donna Young,  who has worked in the Vernal area for 19 years, reported delivering the first stillborn baby she’s seen in all her years of practice in May, 2013. Doctors could not determine any reason for the baby’s death.

While visiting the local cemetery where the parents of that baby had buried their dead child, Young noticed other fresh graves of babies who were stillborn or died shortly after birth.

Young started researching local sources of data on stillbirths and neonatal deaths, like obituaries and mortuary records, and found a large spike in the number of infant deaths occurring in Vernal in recent years. She found 11 other incidents in 2013 where Vernal mothers had given birth to stillborn babies, or whose babies died within a few days of being born.

Vernal’s full-time population is only about 9,800.

The rate of neonatal deaths in Vernal has climbed from about equivalent to the national average in 2010, to six times the national average in 2013.

Along with the surge in oil and gas drilling in the Vernal area over the last few years, the winter time air in the Uintah basin, where Vernal sits, has become dense with industrial smog generated by drilling rigs, pipelines, wells and increased traffic.

Mesa County’s Riverfront Project is a 25+ year project to clean up the Colorado riverfront and create scenic bike and foot trails along the river from Palisade to Fruita. Many volunteers, donors, grants and partnerships have made remarkable progress on the project, and the trails have become a shining star attraction of our area. Views from the existing trails are stunning. New businesses are starting to spring up along the existing trails and further enhance them, like the Botanical Gardens and the new Edgewater Brewery and Pub near the Watson Island section. Tourists and residents alike prize the wildlife, scenic beauty and the huge contribution the trail system makes to this area’s quality of life. But the Mesa County Commissioners, and in particular, Commissioners Rose Pugliese and John Justman, are trying to end to the Riverfront Project by gutting all county funding for it.

Grand Junction Citizens Unveil New Anti-Chamber Website

DumpTheChamberMembers of Grand Junction, Colorado’s “Rein in the Grand Junction Area Chamber of Commerce” Facebook group have unveiled a new website to educate business owners and the public about citizens’ grievances against the Chamber. The site, GJChamber.info, asserts that many of the G.J. Chamber’s actions have hurt local citizens and businesses, and are contrary to citizens’ interests. The site’s pages have titles like “What’s Wrong with the Chamber?,” “Misguided Priorities,” “Bigotry and Intimidation,” “Overbearing Political Involvement,” “The Brainard Debacle” and “Chambermades.” The site provides links to published articles and other references to substantiate information on the site. The group created the site as one-stop shopping, a single place that local business owners can go to find out exactly why the Chamber has drawn the wrath of so many people and businesses in town. They hope that after perusing the site, Chamber member businesses will better understand the issues and consider leaving the Chamber, and that people who have less knowledge of the controversies surrounding the Chamber will be better informed. The group will also promote the site to new business owners so they can get up to speed on the political furor surrounding the Chamber before deciding to join. The site also contains a directory of non-Chamber businesses, to make it easier for people to choose where they want to shop. There are already over 100 businesses on the list. If non-chamber businesses want to be listed on the new site, or if a current Chamber member quits and wants to be listed, they can contact the group through the website and ask that their business be added to the list.

Sentinel Exposes G.J. Chamber of Commerce’s Hubris

The Grand Junction, Colorado Daily Sentinel on July 21 published a scathing expose’ of the Grand Junction Area Chamber of Commerce’s recent activities that have citizens in an uproar.  The Chamber, once seen locally as a respected and helpful institution, in recent years has started engaging in hard-core political activity, and spending plenty on it. In 2011, the G.J. Chamber spent a whopping $74,000 of members’ money on lobbying expense. The next closest comparable Colorado Chamber of Commerce that spent anything at all on lobbying was the Montrose Chamber, which spent just $2,000. The Sentinel also revealed that G.J. Chamber president Diane Schwenke’s compensation far exceeds that of her counterparts at comparable Colorado chambers. In 2011, Schwenke made $133,930 in salary and benefits. Her next closest counterpart made just $112,477. Most of the other presidents of comparable chambers made well under $100,000/year in combined salary and benefits. The G.J. Chamber’s headlong dive into hyper-political activity has led to a backlash among citizens, who have started boycotting Chamber-member businesses. In many citizens’ eyes, the G.J. Chamber stepped out of bounds after it formed a secretive political group, the Western Colorado Business Alliance, that takes in unlimited money and spends unlimited funds to get Chamber-backed candidates elected to local office. The Chamber did exactly that in the last City-wide election, only to have one of their winning candidates, Rick Brainard, get thrown in jail four days after the election for beating up a woman. Brainard pled guilty to assault on May 17.  Throughout his legal travails, Brainard has refused pressure from citizens to resign from Council, and will soon cost City taxpayers $50,000 for a recall effort. Making matters worse, the Chamber continues to back Brainard, making Grand Junction the first city in Colorado to allow a freshly-convicted criminal sit on its Council. Former G.J. Chamber member Harry Griff of the law firm Griff, Larson Laiche & Wright, told the Sentinel he quit the Chamber after being a member for 25 years, calling it “a very, very exclusionary group.” Another business owner, Marilyn Charlesworth, also quit the Chamber over it’s unwelcome political activity, calling it a “little boy’s club.” Other businesses to quit include the CandyTime Shoppe, Pablo’s Pizza and the Hot Tomato in Fruita. New businesses in town are also opting not to join the Chamber due to the firestorm of controversy surrounding the organization. Citizens who are outraged at Chamber activities are boycotting Chamber-member businesses and using Facebook to organize, share strategies and share names of businesses that belong to the Chamber and those that do not, or to name who recently dropped their membership. For its part, the Chamber’s leadership remains completely unapologetic. In response to a question Sentinel reporter Charles Ashby posed about whether the local backlash is having any impact on the Chamber’s decision to get more political in the future, Chamber president Diane Schwenke responded that yes, it’s had an impact, but only to the extent that it will make the Chamber try to become even more effective at its political involvement in the future.

The End of The Grand Junction Area Chamber of Commerce?

The Rick Brainard debacle — the ongoing saga of the newly-elected Grand Junction city councilman who pled guilty to criminal assault minutes before being sworn in as a City Councilman May 6  — has led to greater scrutiny of the Grand Junction Area Chamber of Commerce, the group responsible for foisting Brainard onto the local political scene.

In the decades before Brainard, to the people who even noticed it at all, the Grand Junction Chamber was generally regarded as a well-meaning force in town. Becoming a member of the Chamber was a rite of passage and a feel-good move for businesses, and a way to show support for the community. The Chamber, a long-standing organization incorporated in Grand Junction way back in 1915, typically engaged in helpful and uncontroversial activities like recruiting volunteers to help tutor elementary school kids in reading and promoting its “Blue Band Buy Local” program aimed at keeping local dollars in the area. The Chamber weighed in on policy matters like taxes and fees, but it’s influence wasn’t out-sized. Its political activity stayed in check in part because its 501-c-6 IRS designation limits the amount of lobbying it can engage in. Because it was a relatively helpful, low-key organization, it had few enemies.

All that changed in 2012, when the Chamber  stopped being satisfied to simply weigh in on policy issues like every other nonprofit group in town. Suddenly the Chamber started acting like the sober person in the car who needed to seize the wheel from a drunk. The Chamber decided it needed to force its will upon citizens by actually becoming City Council. In 2012, the Grand Junction Chamber turned ruthlessly competitive, devised a winner-take-all strategy, then stacked the deck to make sure it got what it wanted: total control of City politics.

Philip Morris’ Secret “Ninja Program” (1991)

ninjaIn this 1991 outline, Karen Daragan, Administrator of Media Affairs for Philip Morris USA, describes PM’s secret “Ninja Program,” in which PM recruited individual smokers across the country to act as seemingly independent media spokespeople who would oppose smoking restrictions and cigarette taxes.  Daragan described the rationale for the program:

“Smokers can respond better than we can to these zealots’ positions on smoking restrictions and excessive taxation. Basically, we can get them [smokers] to deliver our messages for us and it works beautifully because they don’t represent big bad tobacco co[mpany], have more credibility [and] can relate to the public better and talk about issues that are affecting them rather than have us talk for them like we did in the past. But they can also go a step beyond. They can…get the antis reacting to them which puts the antis on the defensive for a change.”

Daragan calls PM’s Ninja Program “a proactive media relations tool for us,” and describes how PM’s method of recruiting smokers as spokespeople differs from those of other cigarette companies:

 “We don’t manage smokers rights clubs and organize meetings like our competitors do. What we do is go out and find the most articulate and devoted activists. We call them our ninjas. We feed them with our most powerful information and arguments, media train them and then have our public relations agency go out and pitch stories and set up interviews for them…”

She continues, describing how PM finds their ninjas:

“Right now we have about 30 trained media ninjas across the country…We find them through correspondence with PM, through phone surveys and written surveys among the 12 million people on our database, through word of mouth, LTE’s, and visible activists among the already existing smokers rights clubs across the states.”

PM instructed its “ninjas” to carry specific, corporate-defined messages to the media: “accommodation,” civil liberties, fairness and self-determination.

Two days after Grand Junction Area Chamber of Commerce President Diane Schwenke made her May 5 Facebook post insulting atheists, a YouTube video shows her speaking at a May 7 Mesa County Republican Women’s luncheon with life-sized cardboard cutout of Ronald Reagan beside her. About 8 1/2 minutes into the 22 minute video, Ms. Schwenke starts to talk about the City of Grand Junction’s withdrawal of it’s $6,000 annual membership in the Chamber. (Recall that the City withdrew its membership in the Chamber after the April election saying the Chamber had become too deeply involved in influencing local politics. The City pronounced it a conflict of interest to fund a group that is dedicated to influencing City politics.) The crowd tittered as Ms. Schwenke trivialized the $6,000 loss, saying since her budget is over $600,000, and the City’s membership represented a mere “one percent or less” of her overall operating budget.  Schwenke discussed how the story of the City yanking its Chamber funding had made her a star. “KKCO managed to get the story on the AP wire and the story made the Columbus, Indiana television station,” Schwenke said. “I had one of my peers in California ask me if I would do a presentation about what it’s like to stand up to the city and have your funding cut. We aren’t funded by the government,” she emphasized, yet in the same talk she thanked Mayor Sam Susuras and Council member Marty Chazen — both backed by the Chamber — for restoring her $6,000 in City funds immediately after they were sworn in. And despite the Chamber’s disastrous backing of Rick Brainard for Council — even after he was arrested just days after getting elected for assaulting his girlfriend badly enough to give her a black eye — Schwenke said, “We have elevated the need for qualified candidates …and I think that in and of itself is good for the community at large.”

To the GOP: If Gun Control Doesn’t Work, Try This Instead

Laws to regulate guns just don’t work. At least that’s what many prominent Republicans say.  In the mean time, the U.S. is awash in guns, judging from the piles of them turned in at buyback programs across the country. While it is unclear whether these programs actually reduce gun deaths, they do prove one thing: Americans have more guns than they know what to do with. Add to this emerging technology that, when gun nuts perfect it, will allow people to manufacture guns using 3-D printers, and we may be so deep in trouble we’ll never dig out. This distribution method will make it completely impossible for government to regulate who gets a gun and who doesn’t. Gun owners and pro-gun legislators repeatedly tout the portion of the Second Amendment that talks about their right to bear arms, but universally ignore the part indicating gun owners are expected to be part of a “well-regulated militia.” All these factors point to one conclusion: the time may  have already passed when we could realistically regulate guns to any desired effect.

So now what?

About 100 citizens of Grand Junction, Colorado rallied outside City Hall today to protest city councilman-elect Richard Brainard’s stated intent to assume office in early May. Linda Moran of the Latimer House organized the rally. Latimer House provides shelter for battered women. Brainard was arrested last weekend after admitting to police that he struck his live-in girlfriend. City Councilman Jim Doody  spoke at the rally, saying Mr. Brainard had already highly embarrassed the city and that citizens are rightly concerned about Brainard’s behavior. Doody announced  that he and fellow councilmember Bennett Boeschenstein plan to write a letter, which they will submit to the rest of Council, asking Brainard not to assume office. The crowd cheered and applauded. Doody warned, however, that Brainard, who has been duly elected, could assume office if he wanted to. Several citizens who spoke said they had voted for Brainard and were now sorry they had. One woman, with three children in tow, said the first thing she teaches her children is not to hit other people, ever. Brainard initially lied to the police after they arrived at his residence early Saturday morning, and denied a physical altercation with his girlfriend. He later admitted to grabbing, pushing and slapping her. A non-redacted version of the police report says “Rick stated that he slapped (girlfriend) because she needed to ‘shut her mouth,” saying she said something so offensive to him “that he had to slap her.” It was also announced at today’s rally that a group of state-approved domestic violence treatment providers from across the western slope have issued a statement  asking Brainard not to take office. Brainard’s next court appearance is May 6, the same day he is scheduled to be sworn into office. Brainard’s lawyer has asked the court to waive the requirement that Brainard attend his court status conference May 6, as well as all future hearings, due to conflicts with his “employment.”

A new petition appeared on the Obama administration’s “We the People” web site March 18 asking that members of the Congress and Senate be required to wear the logos of their financial backers on their clothing, NASCAR style. The petition says, “Since most politicians’ campaigns are largely funded by wealthy companies and individuals, it would give voters a better sense of who the candidate they are voting for is actually representing if the company’s logo, or individual’s name, was prominently displayed upon the candidate’s clothing at all public appearances and campaign events. Once elected, the candidate would be required to continue to wear those ‘sponsor’s’ names during all official duties and visits to constituents. The size of a logo or name would vary with the size of a donation. For example, a $1 million dollar contribution would warrant a patch of about 4″ by 8″ on the chest, while a free meal from a lobbyist would be represented by a quarter-sized button. Individual donations under $1000 are exempt.” Some people have commented that the NASCAR-style clothing requirement would break Congress’s dress code, but the code only requires a coat and tie for men and “appropriate” dress for women. Others say members of Congress and the Senate would have to wear floor-length robes, perhaps with trains, to accommodate all of their corporate backers. So far, the Congressmen-in-NASCAR-clothing petition has gathered 9,378 signatures in just four days. The Obama Administration has raised the number of signatures needed to get a response on a petition to100,000 within 30 days, up from 25,000. The petition can be seen (and signed) here.

Gun Maker Freaks Out, Retaliates Against Colorado Gun Safety Bill

Magpul Industries of Erie, Colorado, which makes and sells  high-capacity ammunition magazines, has declared war on Colorado over a gun safety bill currently moving through the state’s legislature. HB 1224, currently in Colorado’s House of Representatives, would limit high-capacity magazines to 15 rounds, and add a more restrictive 8-round limit for shotguns. Magpul makes 30-round magazines. Magpul threatened to move its business out of state if the bill passes. The House then voted to amend HB 1224 to allow Magpul to keep making its high-capacity magazines and selling them in other states, but that wasn’t enough for the company.  Magpul launched an Internet-based campaign to flood the state with high-capacity, military-grade magazines and weaponry in advance of a vote on the bill. Magpul posted a cold-war style ad on its Facebook page announcing that the company will sell up to ten 30-round AR or M4 ammunition magazines per customer directly to Colorado residents, and will expedite shipping for a discounted price of just $5.00. The ad shows a little girl with pigtails, smiling and reaching up to catch 30-round gun magazines as they are dropped, airlift-style, from an airplane. The copy reads, “In the battle for Colorado Freedoms, support for second amendment rights is being delivered by Magpul Industries Corporation. Fielded in the millions by US and its allies since 2007, the PMAG is the magazine of choice for those defending freedom and democracy around the world…Now, with the ability of Coloradans to purchase new standard capacity magazines in jeopardy, Magpul Industries is working to supply as many as possible to the good people of Colorado. Similar to the Berlin Airlift, the Boulder Airlift will bring much-needed gun supplies to freedom-loving residents trapped inside occupied territory.” In addition to high-capacity magazines, Magpul also makes rifle grips, buttstocks, rifle sights, gun mounts and other gun-related parts and accessories. Colorado Gov. John Hickenlooper has said he will sign the bill if it makes it to his desk. Colorado has a history of gun massacres, including the Aurora Theater massacre in 2012, the Columbine High School massacre in 1999, and the Chuck E. Cheese massacre in 1993, also in Aurora, Colorado, in which a gunman killed four restaurant employees.

Who Funds Rick Berman’s Dark Money Group, the “Center for Consumer Freedom”?

Rick Berman, the D.C. beltway corporate lobbyist who revels in the nickname “Dr. Evil,” is at it again, this time defending a dangerous New Hampshire “ag-gag” bill that would block the ability to build solid court cases against animal cruelty in commercial agricultural operations. Berman also penned an opinion piece in the Boston Globe opposing the “Prevention of Farm Animal Cruelty Act,” a bill that would require federal agencies to buy food products only from farms that raise animals free from cruelty and abuse. Aside from the underlying question of why the Boston Globe would print anything by Rick Berman, a corporate sell-out who lacks completely in credibility, why does Berman persist in supporting something as distasteful and horrifically unpopular as animal abuse?

Berman operates the Center for Consumer Freedom (CCR), an industry-funded front group that relentlessly attacks do-good organizations like the Humane Society of the United States (HSUS), People for the Ethical Treatment of Animals, Mothers Against Drunk Driving and the Center for Science in the Public Interest. Berman uses over-the-top rhetoric, calling people who research and expose the causes behind obesity “food control zealots.” He uses hyperbole and slippery-slope arguments, saying animal welfare groups like the Humane Society are “fighting to get rid of every dairy, pork, egg, beef, veal, and poultry farm across America by increasing the cost of production and hence increasing the price of food.” Hogwash. Whenever possible, HSUS works with commercial ag operations to reduce animal abuses like tail-docking of dairy cows and confinement of animals in horribly small spaces. The groups has been successful in doing so, but does pursue legislation to protect animals, too.

Corporate America’s “Echo Chamber Approach” to Lobbying

echo-chamberA 1998 internal Philip Morris memo, written by John Scruggs of Philip Morris Management Corporation’s Federal Government Affairs (lobbying) Office, describes a key public relations/lobbying technique that corporations use to dominate virtually the entire decisionmaking environment in which legislators operate.  Scruggs calls it the “Echo Chamber Approach to Advocacy.” It involves making a corporation’s chosen message, or slight variations of this message, emanate from virtually every major source that can influence legislators’ decisionmaking: constituents, colleagues, opinion leaders, local and national media like TV, radio, newspapers, fundraisers, advertising, etc.  Scruggs says “…[T]his repetition, or ‘piling on’ approach works” because the message emanates from those who have ” ‘the greatest degree of credibility’ with the legislator.” This memo was created by Philip Morris in the 1990s, but since then, due to the cigarette industry’s pioneering reputation of success at influencing legislators, the technique has doubtless spread and is now likely in use by many more corporations and industries.

They Said It Couldn’t Be Done: NY State Passes Comprehensive Gun Safety Bill

With lightening speed for a state legislature, New York became the first state to pass a comprehensive gun safety bill since the massacre December 14, 2012 at Newtown, Connecticut. New York’s gun control bill, passed and signed today, is the toughest in the nation. It expands the definition of “assault weapon” to include semiautomatic weapons to include those with just one feature commonly associated with military weapons, like a bayonet mount, flash suppressor or pistol grip. Previously the definition required two features. New York’s bill also revokes or suspends gun licenses held by people whom mental health experts determine to be a danger to society. The new law limits magazines to just seven rounds of ammunition instead of ten, and provides for enhanced monitoring of ammunition purchases to flag high-volume buyers. Gun licenses must be re-certified every five years. (They used to never expire.)  The law increases penalties for illegal gun possession and for using a gun against emergency responders. “Common sense can win,” said New York Governor Andrew Cuomo as he signed the bill, less than an hour the New York State Assembly passed it by a vote of 104 to 43 . “You can overpower extremists with intelligence and with reason and common sense,” Cuomo said. The National Rifle Association called the law “draconian,” and said it was passed “under a veil of secrecy in the dark of night.” The bill passed on the second day of New York state’s 2013 legislative session.

NRA Puts President Obama’s Kids in the Political Crosshairs

The National Rifle Association (NRA) posted a 35 second Internet ad called “Stand and Fight” that takes aim at President Obama’s children over the issue of gun safety regulations. The ad accuses President Obama of being an “elitist hypocrite” for accepting armed secret service protection for his children, Sasha, age 11, and Malia, age 14, while other children attend school without armed guards. The voiceover in the ad asks “Are the president’s kids more important that yours? Then why is he skeptical about putting armed security in our schools when HIS kids are protected by armed guards at THEIR school? Mr. Obama demands the wealthy pay their fair share of taxes, but he’s just another elitist hypocrite when it comes to a fair share of security. Protection for their kids and gun-free zones for ours.” There were reports on MSNBC that the NRA pulled the ad almost as quickly as they posted it, but as of this evening the ad was still visible at the NRA’s new website, NRAStandandFight.com.

Agribusiness Pushes “Ag-Gag” Laws Aimed at Keeping Animal Abuse Secret

Whistleblowing employees in the food industry have been credited with exposing horrible instances of animal abuse, unsafe working conditions, and environmental and public health violations on industrial factory farms by filming these conditions and exposing them to the public. But instead of fixing the problems these workers expose, the agribusiness industry is responding by pushing through laws that effectively block the pubic from finding out about these abuses in the first place. These whistleblower suppression, or “ag-gag” bills, criminalize taking photographs or video recordings at factory farms without permission, ban the distribution of such photos or videos and make it a crime to take a job at a commercial farm operation for the purpose of exposing what goes on there. These industry-backed bills would stop undercover activity like that used by the Humane Society of the United States (HSUS) in 2008 to expose animal cruelty at a Vermont slaughter plant that led to a felony conviction and the plant’s closure, and a landmark investigation at a cow slaughter plant the same year that prompted the largest meat recall in U.S. history and spurred a new federal law banning the slaughter of “downer” cattle.
